By accessing or using Fyre Push ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Fyre Push provides web and app push notification delivery services, including subscriber management, campaign creation, analytics, and API access. The Service is provided "as is" with varying features based on your subscription plan.
3. Account Registration
- You must provide accurate and complete information during registration.
- You are responsible for maintaining the security of your account credentials.
- You must be at least 18 years old to create an account.
- One person or entity may not maintain more than one free account.
4. Acceptable Use
You agree NOT to use the Service to:
- Send spam, unsolicited, or deceptive notifications.
- Distribute malware, phishing links, or harmful content.
- Violate any applicable laws or regulations.
- Infringe on intellectual property rights of others.
- Send notifications containing adult, violent, or hate content.
- Attempt to circumvent usage limits or rate limiting.
- Reverse-engineer, decompile, or modify the Service.
5. Subscription & Billing
- Free plans are subject to usage limits as described on our pricing page.
- Paid subscriptions are billed monthly or yearly in advance.
- You may upgrade, downgrade, or cancel at any time.
- Refunds are handled on a case-by-case basis.
- We reserve the right to modify pricing with 30 days notice.
6. Data & Content
You retain ownership of all content you send through the Service. You grant us a limited license to process and deliver your notifications. We do not sell your data to third parties.
7. Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice. We are not liable for any losses due to downtime.
8. Termination
We may suspend or terminate your account if you violate these terms. Upon termination, your data will be retained for 30 days before permanent deletion. You may request data export before termination.
9. Limitation of Liability
Fyre Push shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the last 12 months.
10. Changes to Terms
We may update these terms at any time. Continued use of the Service after changes constitutes acceptance. We will notify users of significant changes via email or dashboard notification.
